If you are attending South Dakota’s largest motorcycle gathering, knowing the cannabis rules can help you avoid choices that may disrupt your plans.
State law allows marijuana for medical use only
Recreational marijuana is illegal for adults visiting the Sturgis Rally. The event creates no exception if you bought it elsewhere. Taking it across state lines can raise federal concerns.
Cardholders can possess medical cannabis. A card from another state does not permit possession, but eligible visitors can apply for nonresident registration. The medical cannabis program lists requirements, such as certification from a practitioner.
What Sturgis Rally visitors need to know
Several cannabis rules affect rally visitors. At the event, keep these points in mind:
- Police enforce cannabis laws during the rally. Officers may investigate suspected possession or impaired driving at traffic stops.
- Simple possession generally carries criminal penalties. Possessing two ounces or less without authorization is a Class 1 misdemeanor. A conviction can bring up to one year in county jail, a $2,000 fine or both.
- Using marijuana in a vehicle is a separate offense. A driver who smokes or consumes it while operating or physically controlling a vehicle commits a Class 2 misdemeanor. A passenger can face the same offense for smoking it while the vehicle is operated.
- Public smoking is barred. Sturgis bars cannabis smoking in public places, on public transportation and at cannabis businesses. A campsite or rental might have rules.
These limits still apply if you purchased the product where adult use is legal. Leaving it at home is often the clearest way to avoid a possession allegation.
