South Dakota First-Offense DUI Defense Attorney In Rapid City

Last updated on February 2, 2026

Do you really need a lawyer for a first-offense DUI? Yes, a lawyer can protect your rights and likely produce a better outcome than if you try to defend yourself. Our experienced South Dakota first-time DUI attorneys will investigate the case against you, determine whether any mistakes were made and build a strong defense.

At Kinney Law, pc, in Rapid City, Spearfish and Sturgis, founding attorney Matt Kinney protects the rights of people charged with DUI. With over 30 years of experience, he knows how to counter DUI charges and consequences such as having a criminal record and worrying about background checks.

Suspended Imposition Of Sentence (SIS)

A SIS can be a good alternative to regular sentencing. You plead guilty, but the judge allows you to complete probation. If you meet all of the requirements, your record will be sealed and will not display on background checks.

You should work with a lawyer on a SIS to ensure that the process goes smoothly and that you complete all of the requirements.

What Are The Penalties For A First DUI Offense?

A first offense is typically a Class 1 misdemeanor with maximum DUI penalties that include:

  • Up to one year in jail
  • A fine of $2,000
  • Mandatory license suspension between 30 days and one year

You may also have to install an ignition interlock device on your vehicle and undergo a chemical dependency evaluation with possible treatment.

The Effect Of A DUI On Your Driver’s License

For a first DUI, there is a mandatory license suspension of 30 days, but the suspension can be as long as one year in some cases. You can request a hearing to challenge the suspension within 10 days of the arrest. Attorney Kinney can also help you get a restricted license to drive for work, school and counseling.

Note that refusing to take a blood, breath or urine test will mean a one-year license suspension.
