What Are The Penalties For Assault In South Dakota?

Simple assault is usually charged as a misdemeanor unless you have prior convictions or the alleged victim falls into a certain category, such as when they are a corrections officer, police officer, firefighter or health care employee who was on the job at the time. Even so, a misdemeanor assault conviction can lead to a $2,000 fine and up to a year in jail.

If you are charged with a felony-level assault, the consequences are even more grave. An aggravated assault conviction that does not include any special factors, for example, can lead to $30,000 in fines and up to 15 years in prison.
